PeterChesapeake Bay Nitrogen Reduction Act of 2009

Two Sessions today to try to get as many pieces of legislation finalized before we break for Easter.  We voted on SB 554 – Chesapeake Bay Nitrogen Reduction Act of 2009 which prohibits both the installation of a new septic system, as well as the replacement of a failing septic system, within the Chesapeake and Atlantic Coastal Bays Critical Area unless the new or replaced system utilizes the best available technology for nitrogen removal.

There was heavy debate on this bill in both chambers of the General Assembly.  I voted for this bill because it provides a way for those who would like to upgrade their systems but cannot afford the additional expense.  In Charles County we often hear of individuals who have failing septic systems but cannot afford the upgrade.  The funds are available for these upgrades and I hope that more people will consider this option when they make their plans.

    Delegate Murphy, I applaud your support for this bill but your constituents already had access to grant funding for septic system upgrade/replacement through the Bay Restoration fund (i.e. flush tax). You should know that these funds cannot be used for a new drain field and that the cost of electricity to run the blower is paid by the homeowner also. It’s still something I support.
